Privacy Policy

Textatron is a product of DeskDialer. DeskDialer provides Textatron as a communications platform that enables participating businesses, apartment communities, property managers, homeowners associations, organizations, and similar entities to send informational SMS/MMS messages to individuals who have voluntarily chosen to receive them.

This Privacy Policy explains how DeskDialer and Textatron collect, use, protect, and disclose information in connection with the Textatron website, SMS messaging program, opt-in pages, administrative tools, and related services.

1. Information We Collect

Textatron may collect information you voluntarily provide when enrolling in or using the service, including:

  • Mobile phone number
  • SMS opt-in and consent information
  • Date and time of enrollment
  • SMS opt-out status
  • Communications sent to or received from the Textatron messaging service
  • Message delivery and status information
  • Information submitted when requesting assistance

For Textatron administrative users, DeskDialer may also collect:

  • Email address
  • Account credentials
  • User access level
  • Administrative and service activity

2. How We Use Information

DeskDialer and Textatron may use collected information to:

  • Provide requested SMS/MMS notifications
  • Administer Textatron messaging programs
  • Maintain SMS opt-in and opt-out preferences
  • Process STOP, START, UNSTOP, HELP, and similar messaging commands
  • Send property, maintenance, utility, parking, community, emergency, safety, event, office, and other service-related notifications
  • Monitor message delivery
  • Troubleshoot messaging problems
  • Prevent fraud, misuse, or unauthorized access
  • Provide customer support
  • Maintain records of messaging consent and service activity
  • Operate, secure, maintain, and improve Textatron

3. SMS Messaging Privacy

Mobile phone numbers, SMS opt-in information, and messaging consent will not be shared, sold, rented, transferred, or provided to third parties or affiliates for their marketing or promotional purposes.

This restriction applies to mobile information and SMS consent regardless of any other provision of this Privacy Policy.

DeskDialer may provide mobile information to telecommunications carriers and service providers only when necessary to operate, support, and deliver the Textatron messaging service. These providers may include Twilio, wireless carriers, hosting providers, and technical service providers.

Such service providers may use this information only as necessary to perform services supporting Textatron and are not authorized by DeskDialer to use SMS opt-in information or messaging consent for their own marketing or promotional purposes.

4. SMS Message Frequency and Charges

If you voluntarily opt in to a Textatron messaging program:

Message frequency varies.

The number of messages you receive depends on the communications needs of the participating business, property, association, or organization.

Some periods may have no messages, while other periods may include multiple notifications.

Message and data rates may apply.

Your wireless carrier’s standard messaging and data charges may apply according to your mobile service plan.

5. SMS Consent

Textatron only sends recurring SMS/MMS communications to users who have voluntarily provided consent to participate in the applicable messaging program.

Consent may be provided through an approved Textatron opt-in process, such as:

  • Entering a mobile telephone number on a Textatron opt-in page and actively selecting an unchecked SMS consent checkbox; or
  • Using a supported SMS keyword opt-in process where offered by the applicable messaging program.

SMS consent applies only to the specific messaging program for which consent was provided.

Consent to receive Textatron SMS/MMS messages is not a condition of purchasing goods or services, entering into a lease, creating an account, maintaining an account, or receiving unrelated services.

SMS opt-in consent is not transferable to another business, organization, affiliate, or messaging program.

6. Opting Out of SMS Messages

You may withdraw your consent and stop receiving messages from an applicable Textatron messaging program at any time by replying:

STOP

A confirmation may be sent acknowledging your opt-out request.

After your opt-out request has been processed, you will no longer receive recurring messages from that messaging program unless you voluntarily opt in again.

8. Opting Back In

If you previously opted out and later wish to receive messages again, you may complete the applicable Textatron opt-in process again.

Where supported, you may also use an approved opt-in keyword such as START or UNSTOP.

9. Message Delivery Information

Textatron may receive information from telecommunications providers regarding the delivery of SMS/MMS messages, including:

  • Recipient mobile number
  • Message identification number
  • Message status
  • Delivery status
  • Error codes
  • Date and time of status updates

This information may be used to operate the messaging service, provide delivery reporting, troubleshoot technical issues, maintain records, and administer the applicable Textatron account.

10. Service Providers

DeskDialer may use service providers to operate Textatron.

These providers may include:

  • SMS and telecommunications providers
  • Wireless carriers
  • Website hosting providers
  • Infrastructure providers
  • Security providers
  • Technical support providers

Information may be provided to these service providers only as reasonably necessary to provide and support Textatron.

Mobile phone numbers, SMS opt-in information, and messaging consent are not shared with these providers for their own marketing or promotional purposes.

11. Information Disclosure

DeskDialer may disclose information when reasonably necessary to:

  • Operate and provide Textatron
  • Transmit requested SMS/MMS communications
  • Protect the security and integrity of Textatron
  • Prevent or investigate fraud, abuse, or unlawful activity
  • Comply with applicable laws, court orders, subpoenas, or lawful government requests
  • Protect the legal rights, safety, or property of DeskDialer, Textatron users, or others

However, mobile phone numbers, SMS opt-in information, and messaging consent will not be sold, rented, shared, transferred, or otherwise provided to third parties or affiliates for marketing or promotional purposes.

12. Data Retention

DeskDialer may retain information for as long as reasonably necessary to:

  • Provide Textatron services
  • Maintain SMS consent and opt-out records
  • Maintain messaging and delivery records
  • Provide customer support
  • Resolve disputes
  • Prevent fraud or misuse
  • Meet contractual or legal obligations
  • Maintain appropriate business records

Opt-out and consent records may be retained as necessary to document messaging preferences and prevent unwanted communications.

13. Data Security

DeskDialer uses reasonable administrative, technical, and organizational safeguards designed to protect information from unauthorized access, disclosure, alteration, misuse, or loss.

No website, Internet transmission, telecommunications network, or electronic storage system can be guaranteed to be completely secure.

14. Children’s Privacy

Textatron messaging programs are not directed to children under 13, and DeskDialer does not knowingly collect personal information from children under 13 through Textatron.

If DeskDialer becomes aware that information from a child under 13 has been collected without appropriate authorization, reasonable steps will be taken to delete that information.

15. Third-Party Telecommunications Services

Textatron relies on third-party telecommunications providers, including Twilio and participating wireless carriers, to transmit and deliver SMS/MMS communications.

These providers may process mobile telephone numbers, message content, and delivery information as necessary to provide telecommunications services.

Their handling of information may also be subject to their respective privacy policies and legal obligations.

This operational processing does not authorize the use of Textatron SMS opt-in data or messaging consent for third-party marketing or promotional purposes.

16. Changes to This Privacy Policy

DeskDialer may update this Privacy Policy periodically to reflect changes in Textatron, applicable laws, industry requirements, or business practices.

The current version will be posted on the Textatron website with an updated effective date.

17. Terms of Use

Use of Textatron and participation in Textatron messaging programs are also subject to the Textatron Terms of Use.
